ORDER
(Order of the Court was made by S.M.Subramaniam J.) The online rejection intimation given to the petitioner in response to the application submitted seeking a certificate that the petitioner do not belong to any caste or community is under challenge in the present writ proceedings. 2.
The petitioner has submitted an application before the Tahsildar through online seeking a certificate that he do not belong to any caste or community. The Tahsildar rejected the application on the ground that there is no provision to issue such a certificate.

This Court is of the considered opinion that the petitioner, if submits an application seeking a community certificate, then alone, it will be issued by following the procedure. There is no provision to issue a certificate
stating that he do not belong to any community. For the said purpose, no such certificate is required, and it is left open to the petitioner not to declare his community in any application, document or otherwise. It is the liberty of the citizen under the Constitution.

Therefore, this Court do not find any infirmity in respect of the order of rejection passed by the Tahsildar in Proceeding Petition No. 5992132 dated 14.08.2023. It is the absolute choice of the petitioner not to disclose his community in any of the Government records or otherwise. 5.
However, the Government may consider entertaining such applications in order to encourage citizens, who are willing to remove their caste from the records. Such an effort will contribute for creating a casteless society, which is the philosophy and ethos of the Constitution. 6.
