Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents 1 to 4 to issue orders, approving the appointment of the petitioner, Sr.P.A.Sowmya, working as Music Teacher in the 5th respondent Presentation Convent Hr.Sec.School, Coimbatore, Coimbatore District - 641 001 with effect from 16.06.2023 and release salary with all service and monetary benefits. ORDER
This Writ Petition has been filed for a direction directing the respondents 1 and 4 to grant approval of appointment of the petitioner to the post of Music Teacher in the fifth respondent School.
2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents 1 to 4 and perused the materials available on record.
3. The petitioner was appointed as Music Teacher in the sanctioned post as per staff fixation order issued by the third respondent for the academic year 2022-2023 as well as for the year 2023-2024 in the fifth
respondent School. After her appointment, the fifth respondent had sent a proposal for approval of appointment of the petitioner in the post of Music Teacher with effect from 16.06.2023 to the fourth respondent on 12.09.2023. However, it is pending on the file of the fourth respondent and so far, no order has been passed for approval of appointment of the petitioner in the post of Music Teacher.
4. Considering the above, the respondents 1 to 4 are directed to consider the proposal sent by the fifth respondent for approval of appointment of the petitioner as Music Teacher, within a period of twelve weeks from the date of receipt of a copy of this order.
