ORDER

The petitioner apprehends arrest for the alleged offence under Sections 303(2) of BNS (which can be compared to sections 430 of IPC) and section 88(5) of Mines and Minerals (Development and Regulation) Act 1957, in Crime No.495 of 2025, on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the petitioner went to the Cheyyar river and illegally quarried one unit of sand from the river by using tractor and lorry. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and has not committed the offences alleged by the defacto complainant. He also submitted that the petitioner is ready to abide with any conditions that may be imposed by this Court, and therefore, he prayed to grant anticipatory bail to the petitioner.

4. The learned Public Prosecutor, submitted that a huge quantity of sand has been illegally extracted from the river. Hence, he opposed to grant

anticipatory bail to the petitioner.

5 Considering the nature of offence committed by the petitioner, and taking note of the fact that the petitioners are not only involved in quarrying river sand but also in damaging the ecology and the river itself, this Court is not inclined to grant anticipatory bail to the petitioner.
