The petitioner, who apprehends arrest at the hands of the second respondent police for the alleged offences punishable under Sections 420, 294, 506 and 34 of IPC, 1860 in Crime No.344 of 2025, on 1/5
the file of Inspector of Police, Badabazar Police Station, Berhampur District, Odisha, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with one Mr.Paresh Ranjan Sahu were doing construction business in Hosur. The said Paresh Ranjan Sahu hails from State of Odisha, during the COVID-2019, he requested to lend money against mortgage for four wheeler car bearing Registration No.OD-02-BP4568 Engine No. B4DA4176033909, Chasis No. MEERBC003LB 069809 being a partner. At this juncture, the petitioner lend hand loan against mortgage of car, for which, the said Paresh Ranjan Sahu and his cousin executed forms and documents and thereafter, the said Paresh Ranjan Sahu left Tamil Nadu and settled in Odisha. On August, 2025, the 2nd respondent police summoned to the petitioner, after receiving the summon, the petitioner appeared before the 2nd respondent police.
facts and mortgaged the car with the petitioner and further the owner of the car came to know the EMI is defaulted with ICICI Bank, now the owner of the car preferred a complaint before the 2nd respondent police that the said Paresh Ranjan Sahu and one Sargam Tripathy cheated him, and the 2nd respondent police registered an FIR in Crime No. 344 of 2025 dated 29.07.2025 for the offences u/s. 420, 292, 506 and Section 34 of IPC, 1860 against Paresh Ranjan Sahu and Sargam Tripathy and the petitioner herein.
3. Learned counsel for the petitioner/A3 submitted that a false complaint has been given against the petitioner and he has nothing to do with the said allegations. He further submitted that Inter-State Anticipatory bail may be granted to the petitioner to enable him to move the appropriate jurisdictional Court for necessary relief.
4. Taking into consideration the aforesaid facts and circumstances of the case, this Court is inclined to grant Inter-State Interim Anticipatory Bail to the petitioner for a period of four weeks from today to enable him to move the concerned Court. 3/5
5. Accordingly, Interim Inter-State Anticipatory Bail is granted to the petitioner for a period of four weeks, on condition that the petitioner shall surrender before the learned Judicial Magistrate, Hosur, Krishnagiri District, within a period of fifteen days from the date on which the order copy made ready and the petitioner shall execute a bond a for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each for a like sum to the satisfaction of the said learned Magistrate. Further, within four weeks from the date of execution of bail bond, the petitioner shall approach the competent Court and seek for appropriate relief.
