ORDER

The limited request sought in this writ petition is for a direction to the respondent for early disposal of the appeal filed by the petitioner along with two others on 14.10.2024.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader accepting notice for the respondent. 1/3

The said appeal was filed under Section 47-A(5) of the Indian Stamp Act before the respondent challenging the order dated 26.9.2024 passed by the District Revenue Officer (Stamp Paper), Chennai-1 calling upon the petitioner and two others to pay an enhanced stamp duty on the ground that the stamp duty paid was undervalued. Though the appeal was filed on 14.10.2024, no inquiry notice has been received to date. Therefore, the petitioner, who purchased the property in question pursuant to an auction sale conducted by the HDFC Bank Ltd., is before this Court.

Considering the limited relief sought and also considering the fact that the petitioner and two others are the successful bidders in the auction sale conducted by the Authorized Officer of the HDFC Bank Ltd. having paid a sum of Rs.3,61,00,000/-, the writ petition is allowed and the respondent is directed to consider the appeal dated 14.10.2024 filed by the petitioner and two others, hear the same after issuing notice to the petitioner and the other co-sharers and pass appropriate orders within a period of four months from the date of receipt of a copy of this order. No costs.
