The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 332(b), 64(2)(k) & 62 of BNS Act, 2023 in Crime No.31 of 2025, on the file of the respondent police, seeks anticipatory bail.

2. The allegation against the petitioner is that he trespassed into the defacto complainant's house in an inebriated condition and forcibly attempted to rape the victim girl, who is a mentally disorder person. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any such offence as alleged by the defacto complainant and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that the investigation is pending. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, taking note of the submission made by the learned Government Advocate (Crl.Side), the nature of allegation levelled against the petitioner and the gravity of offence, this Court is not inclined to grant anticipatory bail to the petitioners.
