ORDER
(Order of the Court was made by the Hon'ble Chief Justice) This petition has been filed for issuance of writ of mandamus directing the respondents to initiate action as against encroachers occupying and enjoying the Government land in survey number. 95/1 in Kumbalam Revenue Village, Kumbalam Post, Soolagiri Taluk and Krishnagiri District, classified as Government land measuring 6 acre and 60 cent.
2. A counter-affidavit has been filed by learned counsel for the State, which reflects that proceedings were drawn against the encroachers and orders under Section 6 of the Tamil Nadu Land Encroachment Act, 1905, were passed on 13.01.2025. In paragraphs
6 and 7 of the counter-affidavit, it has been stated that many encroachers have themselves removed the encroachments like that of cow sheds and other sheds on Anadheenam land. Now, presently, there are no encroachments, except the dwelling houses on the subject land. On receipt of orders from the first respondent, house site pattas will be issued to the dwellers in the said land as per law.
3. In view of the aforesaid statement made on affidavit, we are not inclined to keep this petition pending, but to dispose it of, however, with a direction that all other encroachments including the dwelling houses will also be removed, if not already removed, within the outer limit of four months.
