O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 303(2) & 326(a) of BNS Act, 2023 in Crime No.236 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that he illegally quarrying 1/4 1/4

units of river sand in Shankarabarani river in a bullock cart. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that investigation in this case is still pending and no previous case has been registered against him. However, he oppose to grant anticipatory bail to the petitioner.

5. Considering the above facts and circumstances of the case, the petitioner have illegally quarried sand from Shankarabarani river which is the lifeline of various Districts and since they also caused damage to the ecology and water body, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. 25.09.2025 ssi 2/4
