Prayer : Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus calling for the records pertaining to the order dated 24.06.2023 passed by the 2nd Respondent in Proceeding No.1.G8A/3643/TNSTC/Ko.Ma./2022 reducing the petitioner basic pay by two stages permanently and issuing him a warning and the consequential order dated 03.07.2023 passed by the 3rd Respondent in Proceeding No.2282/P1/Sa.Pa.Pi/TNSTC (Ko)/2023, quash the same and consequently direct the Respondents to restore the petiitoner pay and to treat the entire period from 21.09.2022 to 28.06.
2023 as duty with pay for all purposes and to sanction nd pay the petitioner all the terminal benefits, by taking into account his entire service, including the above period and by granting the petitioner annual increment from 01.08.2022 and by taking into account to salary payable to him as on date of his retirement, after restoration of his pay and after taking into account the above period as duty with pay, within a specified time as may be fixed by this Hon'ble Court with interest at the rate of 12% per annum, award costs.

The present Writ Petition has been filed challenging the order passed by the 2nd respondent dated 26.04.2023 as well as the consequential order dated 03.07.2023.

Though a larger relief has been sought for in this Writ Petition, at the time of arguments, learned counsel for the petitioner fairly submitted that, as against the orders impugned in this Writ Petition, there is an effective remedy of appeal before the 1st respondent, however, inadvertently, the petitioner had failed to prefer an appeal within the prescribed time and therefore, this Court may permit the petitioner to file an appeal before the before the 1st respondent within a reasonable time.

In view of the aforesaid submission, this Court without interfering with the impugned orders, grants liberty to the petitioner to prefer an appeal before the 1st respondent within a period of two (2) weeks from the date of receipt of a copy of this order. If any such appeal is filed, the 1st respondent is directed to consider and dispose of the appeal on merits and in accordance with law, without insisting upon the issue of limitation as expeditiously as possible.
4. Accordingly, the Writ Petition stands disposed of in the above terms. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
