ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c), 22(b) and 29(1) of NDPS Act in Crime No.431 of 2024, on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that, based on a secret 1/4

information, the respondent police went to the spot and found that one person, who is the son of the petitioner herein, was selling Nitrovet tablets and upon enquiry and inspection, it is found that he was in possession of 10 mg of Nitrovet Tablet - 45 nos., and the petitioner along with her sons was also involved in selling the Nitorvet tablets. Hence, this case. 3.

Learned counsel appearing for the petitioner would submit that petitioner is innocent and has not committed any offence and falsely implicated in this case, based on the confession of the arrested accused. He would further submit that the petitioner is ready to produce solvent sureties and to abide by any conditions that may be imposed by this Court and also undertake to appear and to co-operate for the investigation, therefore, he prayed for the grant of anticipatory bail to the petitioner.

Learned Government Advocate (Crl. Side) appearing for the respondent police opposed for granting of anticipatory bail to the petitioner, stating that the co-accused and the petitioner were involved in illegal selling of 45 nos. of Nitorvet Tablets each of 10 milligrams. He further submitted that the petitioner has 5 previous cases.

Government Advocate (Crl. Side) appearing for the respondent police and perused the materials available on record including the FIR. 6.

Taking note of the facts and circumstances of the case and the petitioner herein has 5 previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.
