ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 296(b), 115(2), 118(1) and 351(3) of BNS Act, 2023 in Crime No.103 of 2025, on the file of the respondent police, seeks anticipatory bail.

2. The allegation against the petitioner is that due to quarrel between the 1/4

petitioner and his wife, the petitioner attacked her indiscriminately and caused severe fractures on her forehead and head and after three days injured discharged from the hospital. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that he is innocent and he has not committed any such offence as alleged by the defacto complainant and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that due to quarrel, the petitioner brutally attacked his wife and caused head injuries. He further submitted that investigation is still pending. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, taking note of the submission made by the learned Government Advocate (Crl.Side), the gravity of offence and the allegation levelled against the petitioner that he brutally attacked his wife, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. 2/4
