Respondents Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the 2nd respondent to implement the order passed by the 1st respondent in Oo.Mu.No.13608/2021/PE dated 09.08.2021 within a time frame stipulated by this Hon'ble Court.

ORDER

This writ petition has been filed for issuance of a mandamus to the second respondent to implement the order passed by the first respondent dated 09.08.2021 to prevent/restrain the local persons and others from using the land belonging to the petitioner as a burial ground.

2. Heard the respective learned counsel appearing for the parties.

3. Taking into consideration the facts and circumstances of the case and also the proceedings of the first respondent dated 09.08.2021 and the earlier order passed by this Court in W.P.No.35052 of 2013 dated 28.11.2016 and after considering the written instructions received from the Assistant City Planner, Tiruvannamalai City Municipal Corporation, there shall be a direction to the second respondent to ensure that the land belonging to the petitioner is not used as a burial ground and such burial/cremation takes place only in the designated place.

4. This writ petition is disposed of with the above direction. Consequently, W.M.P.No.17667 of 2024 is closed. No costs. Index : yes/no 20.08.2025 ss
