Prayer: Writ Petition is filed under Article 226 to issue a Writ of Certiorarified Mandamus calling for the records of the impugned refusal check slip RFL/Joint-2 Sub-Registrar Kancheepuram / 24/2024 dated 11.09.2024 and quash the said impugned order consequently direct the respondent to register the sale deed dated 02.09.2024. O R D E R

The Writ Petition has been filed to call for the records of the impugned refusal check slip RFL/Joint-2 Sub-Registrar Kancheepuram/24/2024 dated 11.09.2024 and quash the said impugned order and consequently direct the respondent to register the sale deed dated 02.09.2024.

2. Aggrieved by the refusal check slip issued by the registering authority on the basis of the letter received from the Sub Inspector, Economic Offences Wing, Ashok Nagar, the petitioner is before this Court.

3. Heard the learned counsels on the either side and perused the records.

4. The Inspector General of Registration, has issued a Circular in No.22482/C1/2022 dated 12.07.2024 to the Registering Authorities, 2/5

stating that the registering authority shall not refuse to register the document merely on the basis of the letter issued by the Police Officials, which is not backed by the Court orders.

5. That apart, the reason for refusal does not form one of the grounds for refusal as set out in Section 22 A of the Registration Act. Therefore, the impugned refusal slip is quashed and the respondent is directed to register the document, within a period of 2 weeks from the date of receipt of a copy of this order.

6. The Writ Petition is allowed. No costs.
