2.Heard the learned Counsel for petitioner.
3.Mr.G.Saibaba, learned counsel appearing for the respondent submitted that the reason given by the petitioner that the petitioner is not well and took native treatment, cannot be accepted. No documents or medical records produced to show that the petitioner was really ill.
4.Considering the fact that it is a case under Section 138 of the Negotiable Instrument Act, to find out the possibility of settlement so that the respondent can see the colour of the coin, this Court condons the delay and the petition is ordered.
