THE HONOURABLE MR. JUSTICE D.BHARATHA CHAKRAVARTHY Suo Motu TR.No.16798 of 2025 (CC.35/2019 of DISTRICT MUNSIF CUM JUDICIAL MAGISTRATE, MADUKKARAI, Madukarai Taluk, Coimbatore) For Petitioner : Mr.S.Vinoth Kumar Government Advocate (Crl.side)

ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.This case in Cr.No.310 of 2016 was registered for the alleged offences under Sections 294(b), 323, 506(1), 427, 448 and 147 of the Indian Penal Code, 1860. It is reported that both the defacto complainant and the accused were from North India and they have gone back to their places. Presently, both of them are not traceable.

3.Considering the nature of allegation, the antecedents of the accused, it is evident that even if the accused is brought to face trial, it would impinge upon his right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served. Page No.1 of 2 https://www.mhc.tn.gov.in/judis
