] This petition is filed to condone the delay of 290 days in filing the above Original Side Appeal.

2.Learned counsel for the petitioners states that private notice was served on unserved respondents. He further submits that, except R1, other respondents remained ex parte before the lower Court.

3.In such circumstances, this Court is inclined to dispose of the matter on merits. Though the learned counsel appearing for the 1st respondent has serious objections, this Court finds that the petitioners have given sufficient reasons to the satisfaction of this Court to condone the delay. This Court is fully convinced with the reasons to condone the delay. Hence, the delay is condoned and this petition is ordered.
