ORDER

This Writ Petition has been filed to direct the respondents 1 and 2, in particular the 2nd respondent, to cancel the two fraudulent Legal Heirship Certificates issued in favour of the 4th respondent namely certificate No.10123/2007/A9 dated 28.07.2007 and certificate No.8943/2007/A9 dated 12.09.2007 and to take appropriate action against the officials responsible.

2.The learned counsel for the petitioner would submit that the petitioner's husband N.Ethiraj purchased a property bearing Sy.No.243/2 measuring about 3.39 Acres situated at Vadakkal Village, Chengalpattu Registration Office, Sriperumbudur Division, Kancheepuram District from one P.Manickam and the said P.Manickam purchased the property from one Arumugam and his wife Dhanabakiyam under sale deed dated 22.12.1971 in Doc.No.2682 of 1971. Thereafter, the husband of the petitioner settled the said property in favour of the petitioner vide two documents.

3.The further case of the petitioner is that one S.Gnana Sundaram, died leaving behind his wife Meena and their children namely Ravanan, Sumathi and Balaji. On the death of S.Gnana Sundaram, his legal heirs have obtained a Legal Heirship Certificate No.10123/2007/A9 dated 28.07.2007 and subsequently, the fourth respondent herein, viz., Ravanan, son of Late S.Gnana Sundaram, has obtained another Legal Heirship Certificate as if he is the sole heir of the deceased S.Gnana Sundaram vide Legal Heirship Certificate No.8943/2007/A9

dated 12.09.2007. Further, he has misused the latter mentioned Legal Heirship Certificate and created a forged settlement deed in favour of his wife R.Kavitha, in respect of the property belonging to the petitioner's husband. Hence, the petitioner was constrained to file a suit in O.S.No.181 of 2019 before the District Munsif Court, Sriperumbudur and a police complaint was also lodged in FIR.No.29 of 2014 dated 29.01.2015. Thereafter, the petitioner has now filed the present writ petition seeking for a direction to the respondents 1 and 2 to cancel both the Legal Heirship Certificate issued in favour of the fourth respondent.

4.This Court vide order of this Court 24.10.2025 had asked the second respondent Tahsildar to appear before this Court on 06.11.2025, to verify as to whether both the certificates were issued by the Tahsildar or not. 5.Pursuant to the said order of this Court dated 24.10.2025, the second respondent Tahsildar is present before this Court today and he submits that the Legal Heirship Certificate dated 28.07.2007 is a genuine one which was issued

by the office. However, the other Legal Heirship Certificate dated 12.09.2007, has not been issued by the Tahsildar. Thus, the forged document which is produced by Ravanan/fourth respondent is not a sustainable one and the official respondents are directed to take appropriate legal action as against the person who has produced the forged certificate.
