This civil miscellaneous petition is filed seeking to condone the delay of 265 days in filing the above appeal.

Learned counsel for the petitioner/appellant submitted that notice to the 1st respondent may be dispensed with, since he remained ex-parte before the Tribunal and he has also made an endorsement to that effect. Hence, notice to the 1st respondent is dispensed with.

3. Heard the learned counsel for the petitioner/appellant.

4. Though name of the 2nd respondent has been printed in the cause list, no one has entered appearance on behalf of the 2nd respondent.

5. Sufficient reasons have been given in the affidavit filed in support of the petition. Accordingly, the delay is condoned and the petition is ordered.

It is made clear that the petitioner/appellant will not be entitled for any interest for the delay period of 265 days.

7. Registry is directed to number the civil miscellaneous appeal, if it is otherwise in order and list the same for admission.
