This Transfer Civil Miscellaneous Petition has been filed to withdraw H.M.O.P.No.162/2023 pending on the file of the learned Principal Subordinate Court, Chengalpattu and transfer the same to the learned Family Court at Chennai.
2. When the matter was taken up for hearing, learned counsel for the petitioner submitted that the sole respondent died on 04.01.2024. Therefore, the prayer as sought for in the Transfer CMP has become infructuous.
3. Recording the submission made by the learned counsel for the petitioner, the Transfer Civil Miscellaneous Petition is dismissed as infructuous. There will be no order as to costs. Consequently, CMP No.29578 of 2023 is closed.
