Heard Mr. J.Srinivasa Mohan, Learned Counsel for the Petitioner, Mr. M.Alagu Gowtham, Learned Government Advocate appearing for the First Respondent and Mr. S.J.Mohamed Sathik, Learned Counsel for the Second and Third Respondents and perused the materials placed on record, apart from the pleadings of the parties.

The Writ Petition has been filed challenging the Notice in Na. Ka. 1429/2023/A2 dated 31.08.2023 issued by the Second Respondent for conduct of meeting on 07.09.2023 of the Panchayat Union of the Second Respondent and the decisions taken thereunder.

As the impugned order is a notice for meeting of the Panchayat Union of the Second Respondent, Learned Counsel for the Petitioner seeks permission of the Court to withdraw the Writ Petition reserving the rights of the Petitioner to 2/4

challenge the ultimate decision taken on the ground that notice for conducting meeting had not been served to the concerned Councillors of the Panchayat Union and he has made an endorsement to that effect in the court record. In view of the same, the Writ Petition is dismissed as withdrawn with the aforesaid clarifications. Consequently, the connected Miscellaneous Petition is closed. No costs.
