Claim Petition was filed by four persons, out of which second and third petitioners were sons of the deceased- A.Prakash. At the time of filing the Claim Petition, they were minors. Hence, they were represented by their mother P.Jayashree, first petitioner.
2. Being aggrieved by the dismissal of the Claim Petition, Civil Miscellaneous Appeal was filed by the claimants. By the time the appeal was filed, second and third claimants attained majority. However, third claimant, though attained majority, is a special child and he still needs care and protection, which is given by his mother/natural guardian.
3. Hence, petition is taken out by the appellants to accept the Cause Title, indicating attainment of majority by second and third appellants, and also to retain the guardianship for third appellant.
