O R D E R

The Criminal Original Petition has been filed seeking to modify the condition 4(1) imposed by the learned Judicial Magistrate, Thiruthuraipoondi, on 10.07.2025 in Crl.M.P.No.162 of 2025, granting custody of the vehicle seized in connection with Crime No.242 of 2025 registered on the file of the respondent Police for the offence under Sections 4(1)(C) of TNP (Amendment) Act.

Heard both sides and perused the materials available on record.

It is submitted by the learned Government Advocate (Criminal Side) that the confiscation proceedings have been initiated in this case.

Despite the fact that the confiscation proceedings have already been initiated by the respondent Police, the learned Magistrate passed an order releasing the vehicle by imposing a condition directing the petitioner to execute a own bond of Rs.3 lakhs and to produce two solvent 2/4

sureties jointly or severally for a likesum amount, which is now sought to be modified.

In view of the above, this Court is of the opinion that since a show cause notice has been issued under the Prohibition Act to confiscate the vehicle involved in the offence and it appears that a reply has also been given by the petitioner, this Court is not inclined to allow this petition. 6.

Accordingly, the Criminal Original Petition stands dismissed. The respondent Police are directed to pass final orders in the confiscation proceedings within a period of two weeks from the date receipt of copy of this order.
