Aggrieved by the judgment of acquittal of the respondent, the petitioner/complainant has filed the present petition seeking leave to file an appeal.

2.The learned counsel for the petitioner would submit that though the respondent had not disputed the signature in the cheque, the Trial Court had erroneously concluded that the petitioner had not stated that the cheques were issued towards consideration for supply of M-Sand; and that the evidence would show that the respondent had not rebutted the statutory presumption.
