The present application has been filed seeking to amend the plaint consequent to the death of the first defendant.
2. Naturally, the suit which has been filed seeking partition and separate possession would require an amendment in so far as the shares of the parties are concerned.
3. Taking that particular factor into consideration, this Application stands allowed.
4. The learned counsel for the plaintiff is directed to carry out necessary amendment in the plaint and an amended plaint copy may be filed.
