ORDER
This Writ Petition has been filed seeking a direction to the respondents to consider the representation of the petitioner dated 03.09.2024 and further direct the respondents to combine the petitioner's previous service as Date Entry Operator from 09.03.1992 to 01.06.2001 in the qualifying service of the petitioner for the purpose of pension and further direct the respondents to retain under the old pension scheme.
2. Ms.Janat Sharlee, learned Counsel takes notice for the Respondents.
3. By consent, this Writ Petition is taken up for final disposal today at the admission stage itself.
4. The brief facts of the case of the petitioner are that the petitioner was appointed as Data Entry Operator in the Directorate of Distance Education of Annamalai University on 09.03.1992 on temporary basis and subsequently confirmed in the said post vide orders dated 27.04.1998. While in service, she has taken medical leave and the same was declined by the Department. However, on 03.11.2004, she has been placed in the same Department in some other post and has been changed under new pension scheme. It is the grievance of the petitioner that though she has rendered more than 33 years of service, she comes under new pension
scheme. Hence, she filed the present Writ Petition seeking to be retained under the old pension regime as she joined in the year 1992.
5. Heard the learned counsel appearing on either side and perused the records.
6. Considering the limited relief sought for in the Writ Petition, without going into the merits of the case, this Court directs the respondents to consider the representation of the petitioner dated 03.09.2024 and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
7. With the above direction, this Writ petition stands disposed of. No costs.
