C.M.P.Nos.29110, 29101 & 29109 of 2023 in S.A.No.350 of 2006 G.ARUL MURUGAN, J., In this Second Appeal, the 10th respondent died and these miscellaneous petitions in C.M.P.Nos.29110, 29101 and 29109 of 2023 are filed to (i) condone the delay of 3469 days in filing application to set aside the abatement, (ii) set aside the abatement, (iii) bring on records of the legal heirs of the deceased 10th respondent, respectively.

This Court, by order dated 22.12.2023, issued notice to the proposed respondents. Since notice sent to the respondents 16, 18 and 19 were served and the notice to the respondents 17, 20 to 24 was returned as "Left", this Court, by order dated 21.02.2024, directed to petitioners to take paper publication. Pursuant to the orders, paper publication has been effected in "Malai Malar" daily, Cuddalore Edition on 23.02.2024. The counsel has filed Affidavit of Service and the names of the respondents 16 to 24 are printed in the causelist. However, there is no representation on the side of the proposed respondents. 3.

Heard the learned counsel for the petitioners and perused the affidavit filed in support of these petitions.

Having satisfied with the reasons stated in the affidavit, these C.M.Ps are ordered. Registry is directed to carry out necessary amendments in the second appeal in S.A.No.350 of 2006.

Post the Second Appeal after two weeks.
