ORDER

This petition has been filed seeking to modify the condition passed by this Court in Crl.O.P.No.28219 of 2024 dated 12.11.2024 with a condition to deposit original title deed stands in the name of the petitioner or in the name of his friends or relatives with face value not less than Rs.5 Lakhs.

2. Learned counsel for the petitioner submitted that the petitioner was arrested on 13.09.2024 in Crime No.35 of 2023 registered for the offence under Section 420 of IPC. He further submitted that the petitioner was enlarged on bail by the this Court in Crl.O.P.No.28219 of 2024 dated 12.11.2024, with a condition to deposit the original title deed stands in the name of the petitioner or in the name of his friends or relatives with face value not less than Rs.5 Lakhs.

3. He further submitted that the relatives of the petitioner do not own property worth Rs.5 Lakhs. Therefore, the petitioner seeks modification of the value of the original title deed to Rs.1.85 Lakhs. If the condition is not modified, the petitioner will put to great hardship, hence, he seeks for modification of the condition.

4. Taking into consideration the submission made by the learned counsel appearing for the petitioner, this Court is inclined to modify the condition imposed by this Court in Crl.O.P.No.28219 of 2024 dated 12.11.2024. Accordingly, Paragraph 7 of the said order shall be read as follows :-

"7. Accordingly, the petitioner is directed to deposit original title deed stands in the name of the petitioner or in the name of his friends or relatives (with face value not less than Rs.1.85 lakhs) and on such deposit, ............................."

5. It is made clear that all other conditions remain unaltered.
