This Criminal Original Petition has been filed to transfer the complaint in STC No.749 of 2021 from the file of the learned Judicial 1/4

Magistrate, Ooty, The Nilgiris, to the file of any other appropriate Court.

2. The learned counsel for the respondent would submit that now the entire trial has been completed and the matter was posted for arguments on 09.01.2024. Subsequently, the petitioner filed a petition to recall the complainant. Therefore, already the trial commenced and the matter itself was posted for arguments. Hence, the transfer of proceedings in S.T.C. No. 749 of 2021 cannot be permitted and this petition is devoid of merits and is dismissed.

3. In the result, this Criminal Original Petition is dismissed. However, the Trial Court is directed to complete the trial within a period of three months from the date of receipt of a copy of this order. 18.02.2025 Index:Yes/No kv 2/4
