ORDER

The petitioner/ Periyanambiraja @ Raja was arrested and remanded to judicial custody on 17.07.2025 and the petitioner/ Arunpandian was arrested on 23.07.2025, for the offences punishable under Sections 311 of BNS @ 309(6), 310(2), 312, 331(6) of BNS in Crime No.84 of 2025, registered on the file of the respondent police, seeks bail. 2.

The case of the prosecution is that the petitioners joining hands with other accused trespassed into the defacto complainant's house, assaulted the defacto complainant and their family members using knife and taken away the 8 sovereigns of gold jewels and cash of Rs.15,000/-. Hence, this case.

The learned counsel appearing for the petitioners submitted that the petitioners herein are brothers and they were arrested in another case by execution of PT warrant and falsely implicated in this case by the respondent police; and that the petitioners are ready to abide by any conditions that may be imposed by this Court and sought for bail to the 2/4

petitioners.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioners, reiterated the prosecution case and states that the petitioners herein are arrayed as A7/ Arunpandian and A8/ Periyanambiraja @ Raja. He further submitted that A7 has 11 previous cases and A8 has 9 previous cases; that only 42 grams of gold jewels were recovered till date; and that the investigation is pending.

Considering the facts, grave nature of offence, the previous antecedents of the petitioners, some stolen articles are yet to be recovered and the fact that investigation is pending, this Court is not inclined to grant bail to the petitioners.

Accordingly, this criminal original petition stands dismissed. 25.09.2025 stn 3/4
