ORDER

Mr.Stalin Abhimanyu, learned Additional Government Pleader, takes notice for respondents. By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.

The relief sought in this writ petition is a direction to the 2nd respondent to consider the petitioner's representation dated 10.01.2025 and to promote him as Sub-Registrar Grade-II notionally without reference to the subsequent charge memo punishment and to grant all consequential service and monetary benefits, within a time frame.

3. It is the case of the petitioner that he was fully qualified for promotion to the post of Sub-Registrar Grade II for the panel year 1987-1988. It is the contention of the petitioner that due to a mistake committed by the department, arising out of a wrong interpretation of the relevant rules, the petitioner suffered severe hardship and retired from service only as an Assistant, without being promoted to the post of Sub-Registrar Grade II. 2/5

4. It is the further case of the petitioner that despite being aware of the aforesaid issue, the 2nd respondent has not taken any effective steps to rectify the anomaly. Under such circumstances, ventilating all his grievances, the petitioner submitted a detailed representation on 10.01.2025, seeking re-fixation of his seniority on notional basis and consequently give promotional effect to the post of Sub-Registrar Grade II. However, the said representation is still pending consideration, and no orders have been passed thereon till date. As the said representation did not evoke any response, the petitioner has approached this Court by filing this writ petition.

5. Heard the learned counsel on either side and perused the materials placed on record.

Though very many grounds have been raised in this writ petition, this Court is of the view that it is suffice to direct the 2nd respondent to consider the petitioner's representation dated 10.01.2025 and pass orders on its own merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any opinion on the merits of the claim made by the petitioner. 3/5

With the above directions, this writ petition stands disposed of. No costs.
