ORDER

This Petition has been filed to direct the Respondents 1 and 2 herein to defreeze the petitioner's Bank Account No.1886119000591 in the 2nd Respondent -Bank forthwith.

2. The petitioner was found in possession of 15 packets of tobacco and hence FIR in Crime No.143 of 2025 has been registered against the petitioner for alleged offences under Sections 275, 123, BNSS & 24(1) COTPA Act, based on that, the petitioner's bank account has been frozen.

3. Heard the learned counsel appearing for the petitioner and the learned Government advocate (Crl.Side) appearing for the 1 st respondent and perused the documents placed on record.

4. Taking note of the nature of the crime registered against the petitioner, this Court is of the view that freezing of entire bank account is not proper, that 2/4

too without following any procedures. Further, no intimation was sent to the court concerned, therefore, the 1 st respondent police is directed to issue necessary communication to the 2 nd respondent - bank to de-freeze the account within a period of one week.
