No 397/5A at Kadambanallur Village Mangattucherry, Ranipet District to an extent of 311⁄2 cents with metes and boundaries on the basis of the petitioner's representation dated 25.06.2025. ORDER
This Writ Petition has been filed seeking a direction to the second respondent to measure the petitioner's land comprised in Survey No.397/1B, to an extent of 0.62 cents and the land comprised in Survey No.397/5A, to an extent of 31 1⁄2 cents, situated at Kadambanallur Village, Mangattucherry, Ranipet District, with metes and boundaries.
2. Heard the learned counsel appearing on either side and perused the materials available on record.

A perusal of the records reveals that the petitioner had purchased 62 cents of dry land comprised in Survey No.397/1B and adjacent 31 1⁄2 cents dry land comprised in Survey No.397/5A, situated at situated at Kadambanallur Village, Mangattucherry, Ranipet District, from one G.Radhakrishnan by a registered sale deed dated 31.08.1995 vide document No.1400 of 1995. While being so, the adjacent land owner, one Elumalai Reddiar, and his family members prevented the petitioner from cultivating the land by using fraudulent documents. The petitioner also lodged a complaint and submitted an application to survey his property along with the requisite fees.
4. When there exists a title dispute between the petitioner and the neighbour land owner, the application submitted by the petitioner
for surveying the property cannot be considered by the Revenue Authorities at this stage. After obtaining a declaration and taking possession through the competent Civil Court, the petitioner can very well approach the revenue authorities to survey the property.
5. In view of the above, the application submitted by the petitioner to survey the property cannot be considered. Thus, the writ petition is devoid of merits and is liable to be dismissed.
