These petitions have been filed to condone the delay of 161 days in filing a petition to set aside the abatement on account of the death of the sole appellant, to set aside the abatement and to bring on record the first and second petitioners as the legal representatives of the deceased sole appellant in this Second Appeal.

2. The learned counsel appearing for the petitioners submitted that as the petitioners are the legal heirs of the sole appellant, they have to be impleaded as the appellants in the second appeal.

3. Considering the fact that the petitioners are the legal representatives of the deceased sole appellant, these petitions are allowed. To carry out necessary amendment.
