O R D E R
The civil revision petition is filed to give suitable direction for speedy disposal of IA No.5 of 2021 in OS No.374 of 2019, on the file of the V Additional District Court, Coimbatore, within a reasonable time as fixed by this Court.
2. The defendants have filed a suit in OS No.374 of 2019 on the file of the District Judge, Coimbatore for partition and declaration that the Will dated 01.11.2010 is not valid and also for the consequential reliefs. Pending suit, the petitioner herein has filed the instant application in IA No.5 of 2021 to reject the plaint in OS No.374 of 2019 and the same is till pending. Hence, the petitioner has filed the present civil revision petition for a direction to the trial court for the speedy disposal of IA No.5 of 2021.
3. Pursuant to the direction of this Court, the Registry, on verification through e-filing, has reported that the total pendency of the V
Additional District Court, Coimbatore is 2206.
4. Considering the nature of the application and total pendency of the cases in the concerned Court and also taking note of the fact that the above application was filed in the year 2021, the learned V Additional District Court, Coimbatore is directed to dispose of IA No.5 of 2021 in OS No.374 of 2019, within a period of four months from the date of receipt of a copy of this order.
