ORDER
1. Heard.
2. This Transfer Civil Miscellaneous Petition is filed by husband under Section 24 of the Code of Civil Procedure seeking withdrawal of DVC No.108 of 2024 pending on the file of the Hon'ble Mahila Court, Egmore, Chennai and transfer of the same to the file of the Hon'ble Mahila Court, Chengalpattu.
3. The marriage between the parties was solemnized on 04.07.2019 at St. Antony's Church, Madurantakam, according to Christian rites and faith. The petitioner is the respondent in the Domestic Violence Case. The respondent herein is the petitioner therein. The petitioner states that he is residing within 2/6
Chengalpattu District and that attending the proceedings at Egmore, Chennai causes serious hardship.

The petitioner specifically pleads that on 16.01.2025 he met with a road accident, sustained multiple injuries and is under continuing treatment and follow-up; and that in the present medical condition, long distance travel for court hearings is physically strenuous and medically inadvisable. It is also stated that the distance to Egmore, Chennai is about 90 kms from his place of residence and that his physical incapacity makes repeated travel impracticable.

The petitioner further contends that the respondent has projected a Chennai address for the purpose of the Domestic Violence proceedings, whereas her permanent address is stated to be within Chengalpattu District and the minor child is also stated to be studying at Chengalpattu. According to the petitioner, the natural forum convenient for effective participation in the proceedings is the jurisdictional court at Chengalpattu. 3/6
6. The respondent has also no objection for transfer and both are residing at Chengalpattu.
7. In view of the above, this Court is inclined to allow the Transfer Petition. Accordingly, Tr.C.M.P.
No.1169 of is allowed.
DVC No.108 of 2024 on the file of the Mahila Court, Egmore, Chennai, is withdrawn and transferred to the file of the Mahila Court, Chengalpattu. The Mahila Court, Egmore, Chennai, shall transmit the entire records to the Hon'ble Mahila Court, Chengalpattu, within three (3) weeks from the date of receipt of this order and the Hon'ble Mahila Court, Chengalpattu shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order. C.M.P. No.26323 of 2025 is closed. There shall be no order as to costs. 23.01.2026 mfa 4/6
