2024-01-11Honourable Mr Justice C. Saravanan2 pages

A.No.178 of 2024 A.No.178 of 2024 in Arb.O.P.(Com.Div.) No.412 of 2023 C.SARAVANAN, J.

Counsels for both sides are present.

2. It appears that both the parties are aggrieved by the Award dated 03.09.2022 passed by the learned Arbitrator.

3. The Original Petition filed by the respondents is yet to be numbered as there is a delay.

4. This case was earlier argued briefly. It was pointed by the learned counsel for the respondents that there were no grounds in the petition filed in Arb.O.P.(Com.Div.) No.412 of 2023 and therefore Arb.O.P.(Com.Div.) No.412 of 2023 was liable to be dismissed. The applicant/petitioner has therefore now filed this application to raise additional grounds.

5. This application can be allowed without prejudice to the rights of the respondents. Accordingly, this application stands allowed. The 1/2 https://www.mhc.tn.gov.in/judis
