This application has been filed by the applicant for extending the mandate of the learned Arbitrator who was appointed by this Court on 01.08.2023.

2. Heard both sides.

3. Earlier, on 19.04.2021, the learned Arbitrator who was appointed by this Court has been elevated as a Hon'ble Judge of this High Court, consequent to which, arbitration proceedings could not be completed.

4. The Arbitration proceedings also got stalled on account of Covid-19 pandemic.

5. A formal counter has been filed in the form of formal affidavit.

6. Having considered the arguments advanced by the learned counsel for the applicant and the respondents and being satisfied with the reasons 1/3

given in the affidavit filed in support of this application, this application filed for extending the mandate of the learned Arbitrator passing Award in the arbitration proceedings is allowed.

7. Accordingly, the mandate of the learned Arbitrator, to pass an Award is extended by a period of nine months from today i.e., from 05.02.2024.

8. The learned Arbitrator, appointed by this Court on 01.08.2023, is requested to complete the arbitration proceedings within the stipulated time.

9. This Application, is thus, allowed.
