Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 2nd and 3rd respondents to survey and fix the boundary stones for the lands (partition deed document 1/6

No.1559/2004) comprised survey No.39/2 to extent of 3.35 acre at, Keelmathur Village, Uthangarai Taluk, Krishnagiri District along with the assistance of the fourth respondent within the time frame fixed by this Court. ORDER

This Writ Petition has been filed seeking a direction to the 2nd and 3rd respondents to survey and fix the boundary stones for the lands (partition deed document No.1559/2004) comprised in survey No.39/2 to an extent of 3.35 acre at Keelmathur Village, Uthangarai Taluk, Krishnagiri District along with the assistance of the fourth respondent within the time frame fixed by this Court.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner owns lands comprised in survey No.39/2 to an extent of 3.35 acre at Keelmathur Village, Uthangarai Taluk, Krishnagiri District. In order to survey the said land, the petitioner submitted an application before the respondents and also paid requisite fees for the same. So far the respondents did not take any steps to survey and demarcate the lands belong to the petitioner. Hence, this writ petition.

In view of the above, respondents 2 & 3 are directed to survey the petitioner's aforesaid lands based on the title deed produced by him, after issuance of notice to the adjacent land owners and counter parties, if any, and to serve the survey report to the petitioner within a period of six weeks from the date of receipt of copy of this order. It is made clear that, if the surveyor concerned is obstructed by third parties while surveying the subject land, the said surveyor can approach the jurisdictional police seeking police aid and on such request, the jurisdictional police shall provide adequate police protection to the surveyor.

5. With the above direction, this writ petition is disposed of. There 3/6

shall be no order as to costs.
