PRAYER: This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondent to issue the legal heirship certificate to the petitioner in accordance with law. This writ petition has been filed seeking a direction to the respondent to issue the legal heirship certificate to the petitioner in accordance with law.
2. The case of the petitioner is that the petitioner's grand father
Manikkagounder died on 15.12.1950. At present, only his heirs that is, the grandchildren are live. The petitioner's grand father had five children namely 1) Peruma, 2) Ramayanammal, 3) Venkatachalam,4) Alamelu and 5) Manikkam. Among them, the father of the petitioner namely Manickam had passed away on 20.10.2022. On account of his father's demise, the petitioner has already obtained a legal heir certificate dated 31.12.2022. Thereafter, the petitioner's brother namely Ganesan, who is the grand son of Manicka Gounder has filed a petition before the respondent on 20.08.2024 seeking to grant legal heirship certificate. However, no order was passed till date. Challenging the same, the present writ petition is filed.
3. The learned counsel for the petitioner submitted that this Court may issue a direction to the respondent to consider the petitioner's representation and pass appropriate orders.

The learned Additional Advocate General, assisted by the learned Special Government Pleader appearing for the respondent would submit that as per the G.O Ms. No.110 dated 13.03.2024, the grand children are not entitled to make an application for obtaining the legal heirship certificate. In the present case, the grand father of the petitioner died on 15.12.1950 and the enquiry
revealed that the petitioner's grand father had three wives and the revenue officials were not able to identify the particulars of first wife and legal heir particulars of late Manicka Gounder and hence, the rejection order was passed by the respondent on 24.07.2025. Without challenging the same, the present writ petition is filed. Accordingly, he prayed for dismissal of the petition.
5. In view of the above, this writ petition is dismissed.
