2. Mr.R.Nalliyappan, learned counsel takes notice for the respondent and he has no objection for condoning the delay.

3. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, delay is condoned. C.M.P.No.28618 of 2024 is allowed.

4. The Registry is directed to number the civil miscellaneous appeal and list the matter for admission, if it is otherwise in order.
