Apprehending arrest in connection with Crime No.432 of 2024, registered for the offences punishable under Sections 275 and 123 of BNS, 2023 and Section 24(1) of Cigarette and other Tobacco Products Acts 2003, the present petition has been filed seeking anticipatory bail. 2.The case of the prosecution is that during the search in the petitioner's shop, they found illegally selling the prohibited Hans - 10 packets and Cool Lips - 10 packets. Hence, the case.

3.Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this court. He further submits that the based on the confession of the 1st and 2nd accused, the petitioner herein has been roped in this case. He is no way connected with the alleged occurrence. He would further submit that petitioner is ready to abide by any stringent condition that may be imposed by this Court. 4.The case of the prosecution as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for

grant of anticipatory bail, is that during the search in the petitioner's shop, they found illegally selling the prohibited Hans - 10 packets and Cool Lips - 10 packets. A1 and A2 were arrested in this case and confession statement has been recorded. The petitioner herein is the owner of the petty shop and he was not present in the place of occurrence. He would further submit that there are four previous cases pending as against the petitioners.

5. Having heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record.

6.Taking into consideration the above facts and circumstances of the case and the submission made by the learned Government Advocate, this Court is not inclined to grant anticipatory bail to the petitioner. 7.Accordingly, this Criminal Original Petition stands dismissed. 10.12.2024 ah A.D.JAGADISH CHANDIRA, J.
