Mr.Balan Haridas, learned counsel appearing for the petitioner would submit that since in the writ order it was recorded as if the workman has given consent, he preferred a review application, which was rejected. Thereafter, a clarification petition came to be filed. That being the reason for delay, the present petition is to be considered.

2. The learned counsel for the respondent would oppose the reasons stated for condoning such a long delay, which is neither candid nor convincing and mere filing of review application will not be a ground to condone such a long delay.

3. Undoubtedly, un-condonable delays cannot be condoned by the Courts in a routine manner. However, if reasons are found to be genuine, the Courts are bound to provide opportunity to the parties to adjudicate the merits in the appeal.

4. In the present case the petitioner filed a review application and thereafter a clarification petition. Therefore, the delay cannot be construed as intentional and they are pursuing the matter continuously. Therefore, this petition is ordered and the delay of 726 days in preferring the above appeal is condoned.
