The petitioner has filed this Writ Petition seeking for a Writ of Certiorarified Mandamus, to call for the records in pursuance of the legal heir certificate No.TN7202507221840 issued by the respondent, dated 12.08.2025, quash the same and to direct the respondent to conduct fresh enquiry in respect of the petitioner's representation dated 10.09.2025.
2. Mr.R.Neelakandan, learned Additional Advocate General, assisted by Special Government Pleader, accepts notice on behalf of the respondent. In view of the consent expressed by the learned counsel for the parties, this writ petition is taken up for final disposal at the stage of admission itself.
3. The petitioner claims that he is born out of the wedlock of Thameen and Shaja Beevi and they are his parents. His mother and brother pre-deceased the petitioner's father. During his lifetime, the petitioner's father has also married one Sabura Beevi and out of their wedlock, one Kabeer Ahamed was born. After demise of the petitioner's father, without including the name of the petitioner, the respondent issued a legal heir certificate dated 12.08.2025 in favour of the second wife of Page No.2 of 6
the petitioner's father and her son Kabeer Ahamed. Therefore, on 10.09.2025, the petitioner has made a representation before the respondent requesting cancellation of the said legal heir certificate and also to include his name and his brother's name as legal heirs of the said Thameen. However, till date, no order has been passed. Hence, the petitioner has filed the above writ petition before this Court.

The learned counsel appearing for the petitioner submitted that though this writ petition has been filed challenging the legal heir certificate issued by the respondent, it would suffice, if this Court issues a direction to the respondent to conduct an enquiry for inclusion of the name of the petitioner and his brother as legal heirs of Thameen, by considering his representation dated 10.09.2025, and pass appropriate orders, within a reasonable time that may be stipulated by this Court.

In view of the limited request sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the respondent to conduct an enquiry with regard to the legal heirs of the Thameen, by considering the petitioner's representation dated Page No.3 of 6
10.09.2025 and pass appropriate orders, on merits and in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order, after providing an opportunity of personal hearing to all the legal heirs of the said Thameen.
