ORDER
(Order of the Court was made by S.M.Subramaniam J.) In view of the reasons stated in the accompanying affidavit filed in support of this miscellaneous petition, the delay of 726 days in preferring the
above Writ Appeal is condoned.
2. Accordingly, the Civil Miscellaneous Petition is ordered.
3. Registry is directed to number the writ appeal, if the papers are otherwise in order and post WA.No.605 of 2026 next week.
4. Learned counsel for the respondent furnished a copy of the order passed by the Additional Labour Court, Coimbatore in Execution Petition in EP.No.14 of 2023. The said order would show that Execution Petition is dismissed as not pressed based on the memo filed by the appellant herein.
5. Learned counsel for the respondents would submit that appellant cannot approbate and reprobate by filing a writ appeal on the ground that he has not given consent for settling the issue. On the other hand, he has chosen to withdraw the Execution Petition and received the deposit amount.
