ORDER

The petitioner, who was arrested and remanded to judicial custody on 03.09.2025, for the offences punishable under Sections 296(b), 115(2), 118(1), 351(2) and 109(1) of BNS (u/s. 294(b), 323, 324, 302 and 506(ii) of IPC) in Crime No.315 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner picked up a wordy quarrel with the brother of the defacto complainant, while he was standing near Nemiliyamman temple; that thereby the petitioner abused the defacto complainant's brother and assaulted him with a wooden log on his head and body with an intention to murder and criminally intimidated him. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 03.09.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the injured sustained grievous injuries and still under treatment in hospital; that the petitioner has one previous case under SC/ST Act; and that the investigation is pending. 5.

Considering the facts and circumstances of this case, grave nature of offence, the injured still in hospital and the fact that investigation is pending, this Court is not inclined to grant bail to the petitioner. 6.

Accordingly, this criminal original petition stands dismissed. 25.09.2025 stn 3/4
