Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents 1 & 2 to implement the pension proposals sent by the third respondent in Na.Ka.No.682/02/rp1, dated 18.05.2011, Na.Ka.No.1325/09/rp1, dated 30.08.2011, Na.Ka.No.682/02/rp1, dated 16.07.2012, Na.Ka.No.8856/12/rp1, dated 28.06.2013, Na.Ka.No.1325/09/rp1, dated 05.11.2013 and Na.Ka.No.1325/09/rp1,

dated 06.01.2014 and thereby sanction pension to the petitioner with interest.

ORDER

This Writ Petition has been filed for a direction directing the first and second respondent to implement the pension proposals sent by the third respondent by its proceedings dated 18.05.2011, 30.08.2011, 16.07.2012, 28.06.2013, 05.11.2013 and 06.01.2014.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner is a retired pensioner from Virudhachalam Municipality as Sanitary Supervisor, who retired on 30.06.2013. Thereafter, the Commissioner of Municipality, Virudhachalam, has sent the pension proposal to the respondents 1 and 2 in Na.Ka.No.682/02/rp1, dated 18.05.2011, Na.Ka.No.1325/09/rp1, dated 30.08.2011, Na.Ka.No.682/02/rp1, dated 16.07.2012, Na.Ka.No.8856/12/rp1, dated

28.06.2013, Na.Ka.No.1325/09/rp1, dated 05.11.2013 and Na.Ka.No.1325/09/rp1, dated 06.01.2014. However, the said proposals are pending with the respondents 1 and 2 herein.

4. Therefore, without expressing any opinion on the merits of the writ petition, the respondents 1 and 2 are directed to pass orders on the proposals sent by the third respondent on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. No costs.
