..Respondent Civil Suit filed under Order IV Rule 1 of Original Side Rules and OrderVII Rule 1 of C.P.C., and Sections 2(1)(c)(xvii) read with Section 7 of the Commercial Courts Act, 2015 read with Sections 28,29,134,135 of the Trademarks Act, 1999, praying to;- a) Grant a permanent injunction restraining the defendant acting through or by its partners, men, servants, agents, representative, franchisees, licensees and or all other person acting on its behalf from in any manner infringing or enabling other to infringe plaintiff's trademarks "JEYAM TRADERS"
and other associated trademarks of the plaintiff; b) Grant a permanent injunction restraining the defendant acting through or by its partners, men, servants, agents, representative, franchisees, licensees
and or all other person acting on its behalf from in any manner passing off or enabling other to pass off the plaintiff's trademark "JEYAM TRADERS" or the associated trademarks owned by the plaintiff; c) Direct the defendant to remove the website "http://www.jeyamtraders.co.in/" and to surrender to the plaintiff for destruction, all the infringing covers, labels, invoice/bills, advertising material and other materials with the defendant containing the trademarks and "JEYAM TRADERS";
d) direct the defendant to render accounts of profit made by the use of the deceptively similar trademark/tradename "JEYAM TRADERS"
and "JEYAM TRADERS" amountint to infringement of the registered trademark and/or passing off and pay the same to the plaintiff; e. direct the defendant to pay the costs of the suit; f. pass such further or other relief as this Hon'ble Court may dee fit and proper and thus render justice.

JUDGMENT
When the matter was taken up for hearing, the learned counsel appearing on either side would submit in unison that the parties to the suit have settled the dispute among themselves and an undertaking affidavit has also been filed by the defendant to that effect. The same has also been acknowledged by the respective learned counsel appearing for the parties.
2. Recording the said undertaking affidavit, the suit stands disposed of in terms of the undertaking affidavit filed on 03.06.2026. The said undertaking affidavit shall form part and parcel of the decree. However, there shall be no order as to costs. Consequently, connected applications are closed.
3. The Registry is directed to grant necessary refund of Court fee as per the rules.
