ORDER

The petitioner, who were arrested and remanded to judicial custody on 16.08.2025, for the offences punishable under Sections 126(2), 296(b) and 103(1) of BNS in Crime No.415 of 2025, registered on the file of the respondent police, seek bail.

The case of the prosecution is that on account of civil dispute pending between the petitioners and the defacto complainant's son namely Joseph, it is alleged that on 15.08.2025 at about 20:30 hours, the petitioners restrained the said Joseph in front of the second petitioner's house and abused him in filthy language; they attacked the deceased with wooden logs and stones and caused murder. Hence, this case. 3.

The learned counsel appearing for the petitioners submitted that the petitioner were falsely implicated, they were no way connected to the offence and they are in judicial custody since 16.08.2025. He further submitted that the deceased Joseph is a drunkard and on the date of occurrence, the deceased under the influence of alcohol, fell down in the second petitioner's land, sustained head injury and died. He further 2/4

submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioners. 4.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioners, reiterated the prosecution case and states that the petitioners were involved in the commission of offence and murdered the deceased using stones and wooden logs; and that the investigation of this case is pending. 5.

Considering the facts and circumstances of this case, gravity of offence and the fact that the investigation is pending, this Court is not inclined to grant bail to the petitioners.

Accordingly, this criminal original petition stands dismissed. 25.09.2025 stn 3/4
