O R D E R

This writ petition has been filed seeking issuance of Writ of Certiorarified Mandamus calling for the records of the first respondent's communication dated 22.08.2025 titled "Technical evaluation for the tender" and quash the same, and consequently direct the first respondent to consider the petitioner's financial bid for evaluation under Tender Document Rc No.2425/PS3/2025 dated 04.06.2025.

2.The learned Senior Counsel appearing for the petitioner submitted that the petitioner is engaged in the business of manufacturing and supply of sports equipment and is ISO 9001:2015 certified, having successfully executed Government supply contracts 2/5

across India including with the respondent Authority. The learned Senior Counsel further submitted that with the rich experience, the petitioner participated in the tender issued by the first respondent for Dr.Kalaignar Sports Kit Scheme. The tender was floated by the first respondent on 04.06.2025. Initially, the petitioner submitted its sample on 12.06.2025 and thereafter corrigendum was issued by the first respondent modifying the supply specification by mandating the wooden stumps on 25.06.2025. Hence, the petitioner submitted its sample kit strictly in the format of Annexure-15 on 03.07.2025. 3.The learned Senior Counsel appearing for the petitioner further submitted that the person who obtained tender submitted its sample kit prior to corrigendum, which itself shows the malafide intention of the first respondent to fix the tenderer. The learned Senior Counsel further submitted that as against the rejection of bid, the petitioner preferred appeal before the Secretary, Sports and Youth Affairs Department, however, no order was passed.

4.The learned Advocate General appearing for the first respondent on instructions submitted that the appeal preferred by the petitioner as against the rejection of the technical bid was entertained 3/5

by the Secretary, Sports and Youth Affairs Department and order will be passed in the said appeal within a period of two days. The appeal may end in favour of the petitioner or otherwise. If the appeal end against the petitioner, liberty may be granted to the petitioner to work out the remedy in the manner known to law. He further submitted that till the disposal of the appeal filed by the petitioner, no procurement of sports kit will be made either from the private respondents or from the any other successful bidder. 5.Recording the submissions made by the learned Advocate General appearing for the first respondent, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
