ORDER

The petitioner, who was arrested and remanded to judicial custody on 14.09.2025, for the offences punishable under Sections 316(2), 318(4), 351(2) and 69 of BNS Act, 2023 in Crime No.39 of 2025, registered on the file respondent police, seeks bail.

2.The case of the prosecution is that the petitioner/A1 promised to marry the defacto complainant and had sexual intercourse. Consequent to which she became pregnant and thereafter the petitioner failed to marry her. It is also stated that the petitioner received a sum of Rs.35,00,000/- from her and cheated her. Hence, this case.

3.The learned counsel appearing for the petitioner submitted that the petitioner and the defacto complainant are friends and he has been implicated in this case unnecessarily. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that the petitioner had sexual intercourse with the victim and failed to marry her and also received a sum of Rs.35,00,000/- from her and cheated her.

5.Considering the facts, nature of offence committed by the petitioner and investigation in this case is pending, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition stands dismissed.
